Terms of Service

By accessing or using OmegaBlack's services, website, or any applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms apply to all visitors, users, and others who access or use the Services. By using the Services, you represent that you are at least 18 years old and have the legal authority to enter into these Terms.

OmegaBlack provides threat intelligence services, including but not limited to: • Dark web monitoring and intelligence • Credential leak detection and alerting • Threat actor tracking and analysis • Security reports and briefings • API access to threat intelligence data • Integration with security tools and platforms We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.

To access certain features of the Services, you must register for an account. When you register, you agree to: • Provide accurate, current, and complete information • Maintain and update your information to keep it accurate • Maintain the security of your account credentials • Accept responsibility for all activities under your account • Notify us immediately of any unauthorized access We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or illegal activity.

Certain Services require a paid subscription. By subscribing, you agree to: • Pay all fees associated with your subscription plan • Provide valid payment information • Authorize us to charge your payment method on a recurring basis Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms. We may change our fees upon 30 days' notice. Continued use after a fee change constitutes acceptance of the new fees.

You agree not to use the Services to: • Violate any applicable laws or regulations • Infringe on intellectual property rights of others • Transmit malware, viruses, or harmful code • Attempt to gain unauthorized access to our systems • Interfere with or disrupt the Services • Use the Services for competitive intelligence against OmegaBlack • Resell or redistribute the Services without authorization • Use automated systems to access the Services beyond permitted API usage We reserve the right to investigate and take appropriate action against anyone who violates these provisions.

The Services and all content, features, and functionality are owned by OmegaBlack and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes only. This license does not include: • Modification or derivative works • Commercial resale or distribution • Reverse engineering or decompilation • Removal of proprietary notices All rights not expressly granted are reserved by OmegaBlack.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection and use of data as described in the Privacy Policy. You retain ownership of any data you provide to the Services. You grant us a license to use this data to provide and improve the Services. We will handle your data in accordance with our Privacy Policy and applicable data protection laws.

You agree to maintain the confidentiality of any non-public information obtained through the Services, including but not limited to: • Threat intelligence data and reports • API keys and access credentials • Pricing and contract terms • Any information marked as confidential This obligation survives termination of these Terms for a period of three (3) years.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: • MERCHANTABILITY • FITNESS FOR A PARTICULAR PURPOSE • NON-INFRINGEMENT • ACCURACY OR COMPLETENESS OF INFORMATION We do not warrant that the Services will be uninterrupted, secure, or error-free. Threat intelligence is provided for informational purposes and should not be the sole basis for security decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMEGABLACK SHALL NOT BE LIABLE FOR: • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES • ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless OmegaBlack and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of: • Your use of the Services • Your violation of these Terms • Your violation of any rights of another party • Any content you provide through the Services

Either party may terminate these Terms at any time for any reason. Upon termination: • Your right to access the Services will immediately cease • You must stop using and delete any data obtained from the Services • We may delete your account and associated data • Provisions that by their nature should survive will remain in effect We may suspend or terminate your access immediately if we believe you have violated these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.
